Statement of Reasons for the Area Representation Resolution

The Resolution proposes to change the election of the seven-member at-large LCSD1 Board of Trustees to four at-large trustees, and three area representative trustees elected from three defined Areas of the District.  Public comment is being taken until September 15, 2020. The Board will then decide if the Resolution should be adopted, amended, or rejected.

The Areas must have about the same number of people, to comply with Wyoming statutes and the U.S. Constitution, as counted in the latest Census. Areas will be election districts, so they will include precincts as defined by the Wyoming Legislature next year, when the Census numbers are in. If this election structure is approved, Area lines would be redrawn after every 10-year Census to ensure equal population.

The U.S. Constitution guarantees equal representation (“one person one vote”). The statute that applies is W.S. 21-3-111 (b) and (c).

 LCSD1 divides its 26 elementary and seven secondary schools into three “triads,” with about equal numbers of students in each. The newly drawn Areas would approximate the triads, but we should expect some deviation to assure equal total population and to avoid splitting precincts. That is, an Area may be larger or smaller than a triad to meet requirements of the Constitution and statutes.

Resolution

Approved by LCSD1 Board of Trustees 7-13-20 to create three residence areas

BY motion moved, seconded, and properly approved by vote of the Board of Trustees (the Board) of Laramie County School District No. 1 (LCSD1) at a meeting of the Board held on the 13th day of July, 2020, the Board does hereby resolve as follows:

WHEREAS the Board currently elects its Trustees solely by at-large voting, and

WHEREAS the Board believes that a combination of residence areas and at-large voting will guarantee election of Trustees from three areas that will approximate the three Triads, which may result in more diverse representation on the Board, which may improve educational outcomes for LCSD1, and

WHEREAS the Board desires current LCSD1, Policy Chapter 2, Section 3, to be modified to reflect said change, and

WHEREAS the Board desires to have three Residence Areas that approximate the current boundaries of the Central, East, and South Triads of LCSD1, without splitting voting precincts, with each Residence Area electing one Trustee to the Board who is a resident of that Residence Area, and who is elected only by the voters of that Residence Area, with the balance of the Board to be composed of Trustees to be elected at-large, and

WHEREAS the Board desires that the three Trustees from the Residence Areas be elected at the 2022 General Election, and that a fourth Trustee be elected at large, and

WHEREAS, the Board desires that said Residence Areas be named Residence Areas 1, 2, and 3, and

WHEREAS the Board desires that creating said Residence Areas be done according to all applicable Wyoming law and processes, including W.S. 21-3-111 (b) and (c), now, therefore

IT IS HEREBY RESOLVED that the Board directs the LCSD1 Superintendent or designee to immediately initiate the legal and regulatory process of changing the method of electing Trustees of the Board from the current at-large system to a system of three Residence Areas that approximate the current boundaries of the Central, East, and South Triads of LCSD1, without splitting voting precincts, with each Residence Area electing one Trustee to the Board who is a resident of that Residence Area, and who is elected only by the voters of that Residence Area, with the balance of the Board to be composed of Trustees to be elected at-large, in sufficient time for the new method of electing Trustees of the Board to be in place for the November, 2022 General Election; and

BE IT FURTHER RESOLVED that the Superintendent or designee further works within said legal and regulatory processes to ensure that the Trustees elected from said Residence Areas are elected at the November, 2022, General Election; and

BE IT FURTHER RESOLVED that the Board will work with the Laramie County Clerk and the Laramie County Commissioners as required and in sufficient time to establish Residence Areas for the November 2022 election of Trustees in accordance with the Election Code, and

BE IT FURTHER RESOLVED that this Resolution shall serve as the new LCSD1 Policy, Chapter 2, Section 3, with the following language being maintained as the first two paragraphs of said Policy:

The election of members of the Board of Trustees for Laramie County School District Number one shall be held on the Tuesday next following the first Monday in November in General Election years. Members of the Board of Trustees shall be elected on a nonpartisan ballot in accordance with the provisions of the Wyoming Election Code and the Wyoming Education Code.

Trustees shall within 10 days after receiving notification of their election and before assuming the duties of their offices, appear before some person qualified to administer oaths and take an oath for the faithful performance of their duties as required by law.

BE IT FURTHER RESOLVED that the Board directs the LCSD1 Superintendent or designee to commence the legal process under Wyoming law to adopt said revised LCSD1 Policy, Chapter 2, Section 3.
